Terms and conditions of sale

Article 1 — Purpose and scope

These terms govern distance sales concluded on partyshop.lu between Partyshop S.à r.l.-S and any customer. They are accepted without reservation when the order is confirmed.

They apply to consumers and business customers alike; the provisions on the right of withdrawal benefit only consumers within the meaning of the Luxembourg Consumer Code.

Article 2 — Products

Items are described as accurately as possible. Photographs are illustrative: slight differences in shade or finish do not constitute a lack of conformity.

Our items are party and costume products. Unless expressly stated, they are not protective equipment and must not be used as such. Items reserved for adults or containing small parts carry the corresponding warnings.

Offers are valid while stocks last. Should an item become unavailable after your order, you are informed and refunded without delay.

Article 3 — Prices

Prices are shown in euros, inclusive of all taxes, Luxembourg VAT included. Delivery charges are shown separately before the order is confirmed.

For deliveries outside Luxembourg to a consumer in the European Union, the applicable VAT is that of the country of destination where the regulations so require.

We reserve the right to change our prices at any time; items are invoiced at the rate in force when the order is placed.

Article 4 — Orders

The sale is concluded when you confirm your order, having had the opportunity to review its details and correct any errors. A confirmation is sent to you by e-mail.

We reserve the right to refuse or cancel an order in the event of a previous payment dispute, a manifestly abnormal order, or an obvious pricing error.

Article 5 — Payment

The accepted means of payment are displayed at checkout:

  • bank card and local payment methods via our secure provider (Bancontact, iDEAL, EPS, Przelewy24, Revolut Pay)
  • PayPal
  • bank transfer — Partyshop S.à r.l.-S, IBAN LU79 0019 4155 3798 3000 — BIC BCEELULL, quoting your order number as the reference
  • payment in store on collection

Orders paid by bank transfer are prepared once the funds have actually been received. The order is held for 7 working days pending payment, then cancelled.

We never have access to your card details: they are processed directly by the payment provider.

Article 6 — Delivery

The arrangements, zones and rates are set out in our delivery terms, which form an integral part of these conditions.

Announced lead times are indicative. A delay cannot give rise to cancellation or compensation, unless it exceeds thirty days from the order, in which case the customer may terminate the contract after a formal notice has remained without effect.

You must check the condition of the parcel on receipt and make the usual reservations with the carrier in the event of damage or a missing item.

Article 7 — Right of withdrawal

Consumers have fourteen days to withdraw, under the conditions detailed in our returns policy, which forms an integral part of these conditions and sets out the applicable legal exclusions.

Article 8 — Promotions and discount codes

Promotions, discounts, discount codes and offers announced on partyshop.lu are valid exclusively for orders placed online, including where the order is collected in store. They do not apply to purchases made directly in store, unless expressly stated otherwise.

Unless otherwise stated, offers cannot be combined, are limited to available stock and may carry a validity period or a minimum order value, specified when they are announced.

Where a price reduction is announced, the reference price shown is the lowest price applied on partyshop.lu during the thirty days preceding the reduction.

Article 9 — Legal guarantee of conformity

All our products carry the two-year legal guarantee of conformity provided for by the Luxembourg Consumer Code. This guarantee is independent of the right of withdrawal and is exercised free of charge for the consumer.

In the event of a lack of conformity, you may request repair or replacement of the goods; failing that, a price reduction or termination of the contract. Defects appearing within twelve months of delivery are presumed to have existed on the date of delivery.

The guarantee does not cover normal wear and tear, damage resulting from improper use, or single-use items after use.

Article 10 — Liability

We cannot be held liable where products are used other than for their intended purpose, in particular the use of costume items for protective purposes, or the use of party items by a child without adult supervision.

Latex balloons present a choking hazard for children under eight: adult supervision is essential, and burst or uninflated balloons must be removed immediately.

Article 11 — Personal data

The processing of personal data is described in our data protection policy.

Article 12 — Governing law and disputes

These conditions are governed by Luxembourg law. In the event of a dispute, you may refer the matter free of charge to the Service national du Médiateur de la consommation before taking any legal action.
