Returns and right of withdrawal

Your right of withdrawal

If you are a consumer, you have fourteen days from receipt of your order to withdraw, without having to give any reason.

Where an order contains several items delivered separately, the period runs from receipt of the last item.

How to exercise this right

Inform us of your decision before the deadline expires, by an unambiguous statement:

  • by e-mail to sylvain@partyshop.lu
  • by post to 17, rue de Hollerich, L-1741 Luxembourg
  • or by handing us the form below in store

Then return the items within fourteen days of your statement.

Return costs

Return postage is at your expense. We recommend a tracked shipment: the parcel travels under your responsibility until we receive it.

Refund

We refund all sums paid, including standard delivery charges, no later than fourteen days after being informed of your decision. We may withhold the refund until we have received the items back or you have supplied proof of dispatch.

The refund is made using the same means of payment as the original order, at no cost to you. If you chose a delivery method more expensive than our standard offer, the additional cost is not refunded.

Condition of the items

Items must be returned complete, in their original packaging and with their labels. You are liable for any diminished value resulting from handling other than what is necessary to establish the nature and characteristics of the product — trying a costume on is accepted, wearing it to a party is not.

Un déguisement porté — traces de maquillage, odeurs, salissures, étiquettes retirées — présente une dépréciation dont vous êtes responsable : le montant remboursé est alors réduit à hauteur de cette dépréciation, et peut l'être jusqu'à la totalité du prix lorsque l'article ne peut plus être revendu.

Items excluded from the right of withdrawal

In accordance with the Consumer Code, the right of withdrawal does not apply to:

  • bespoke decorations and creations — balloon columns, arches, garlands, structures and sets made to your specifications of size, colour and theme, which cannot be re-used as they are
  • personalised items — printing, marking, personalised balloons, cakes and party bags made to order
  • articles descellés ne pouvant être renvoyés pour des raisons d'hygiène — maquillage, faux cils, lentilles de contact fantaisie, perruques et postiches, dentiers, masques et cagoules portés sur le visage, accessoires portés au contact du visage ou de la bouche, boucles d'oreilles, ainsi que les collants, combinaisons « seconde peau » et sous-vêtements de déguisement livrés sous emballage scellé
  • perishable goods — confectionery, food products
  • helium-inflated balloons, which by nature cannot be shipped back
  • services fully performed with your prior agreement — entertainment, rentals, set-up and installation already carried out

These exclusions are exhaustive and laid down by law. They do not cover promotional or sale items, which carry the right of withdrawal in the same way as any other item.

Online orders collected in store

An order placed on partyshop.lu remains a distance contract, even when you collect it in Hollerich or Junglinster. The fourteen-day right of withdrawal therefore applies in full, and the refund is made to the means of payment used for the order.

This should not be confused with our exchange conditions for purchases made directly in store, which are a commercial gesture and not a legal obligation.

Purchases made in store

A purchase made directly in store carries no legal right of withdrawal. As a commercial gesture, we accept an exchange or issue a credit note on presentation of the till receipt, for an item that is intact, unused and unworn, complete and in its original packaging: within 24 hours for costumes and fancy dress, within 15 days for party accessories. Wigs are neither taken back nor exchanged. The credit note is valid for one year in both our stores. No cash refunds.

Excluded from this exchange facility: promotional and end-of-line items, worn costumes, make-up, wigs, unsealed lenses and hygiene accessories, confectionery, inflated balloons, and bespoke decorations and creations.

Rentals

Rental contracts concluded for a specific date are subject to specific conditions communicated with the quotation. Cancellation terms are expressly set out there.
